State and local measures add another layer. California has moved to curb certain automated decisions, and Illinois requires companies to disclose when video interviews employ AI. A violation can lead to penalties and private lawsuits.
In New York City, employers using automated tools for hiring must now commission independent bias audits. These reviews must check for performance gaps across gender and race, and applicants must be informed in advance if a machine-driven evaluation will take place.
Adhering to these rules is not only about avoiding fines—it helps build trust. Trustworthy automation can protect brand reputation, improve employee morale, and reduce legal exposure. Companies that can demonstrate fair, accountable systems are more likely to gain support from customers, employees, and regulators.
